These Terms of Use ("Terms") govern your use of the iOS and iPadOS applications ("the App") published on the Apple App Store by the company named below. By downloading or using the App, you agree to these Terms.

In short: You get a personal licence to use the App. In German Vocabulary, full access is a single one-time purchase — there is no subscription. Where one of our other apps offers an auto-renewing subscription, it renews until you cancel it in your Apple Account settings, and every term is shown before you buy. Purchases are handled by Apple. Apple is not responsible for the App — we are.

1. Who we are

These Terms are a legal agreement between you and us. This agreement is concluded with us alone, not with Apple. In addition to these Terms, your use of the App is subject to Apple's Licensed Application End User License Agreement and to the Apple Media Services Terms and Conditions; where those terms grant users greater rights, they apply.

2. Licence to use the App

We grant you a personal, non-transferable, non-exclusive licence to install and use the App on any Apple-branded device that you own or control, as permitted by the Usage Rules in Apple's Media Services Terms and Conditions. The App may also be accessed by other accounts associated with you through Family Sharing or volume purchasing, where enabled.

3. What you may not do

You agree not to:

copy, redistribute, sell, rent, sublicense, or lease the App except as these Terms allow;
reverse engineer, decompile, or disassemble the App, except to the extent this is expressly permitted by applicable law;
remove or alter any proprietary notices; or
use the App in any unlawful way or in a way that could damage or impair it or the experience of others.

4. The friends leaderboard: nicknames and fair play

Where your version of the App offers the optional friends leaderboard, the following additional rules apply:

Your nickname. You choose a nickname; it is shown, together with your learning figures, only to friends you invite or accept. It must not impersonate a person or brand, include another person's personal data, or be offensive, discriminatory or otherwise unlawful.
Your content. You grant us the non-exclusive technical right to store your nickname and figures and to show them to your connected friends — that is what the feature does. The data involved is described in the privacy policy.
Fair play. You agree not to manipulate scores or streaks, abuse invite links, access the service by automated means, or use the leaderboard to harass or spam others.
Moderation. We may refuse or reset a nickname, remove content, and restrict, suspend or delete a leaderboard profile that violates these rules or applicable law; serious or repeated violations may lead to permanent exclusion from the social features. A leaderboard measure never affects your learning features or any purchase.
Reporting and blocking. You can block people and report abuse directly in the App; reports are handled as described in the privacy policy.
Availability. The leaderboard is an online service and may evolve; we may modify, suspend or discontinue it, giving reasonable notice where legally required. Your statutory rights remain unaffected.

5. Purchases, subscriptions and lifetime access

Some of our apps offer paid content or features. Where they do, the name of the item, what you receive, and the price are shown on the purchase screen in the App before you confirm, in your local currency where available. Payment is charged to your Apple Account when you confirm the purchase.

Auto-renewable subscriptions

An auto-renewable subscription gives you access to the paid content or features for a recurring period. The following applies where an app offers one:

Title, length and price. The name of the subscription, its length (for example, monthly or yearly), and its price are shown on the purchase screen before you confirm.
Automatic renewal. The subscription renews automatically for the same period, at the then-current price, unless you turn off auto-renewal at least 24 hours before the end of the current period. Your Apple Account is charged for the renewal within the 24 hours before the current period ends.
Managing and cancelling. You can view, manage, and turn off auto-renewal at any time in your Apple Account settings (on your device: Settings → your name → Subscriptions). Cancelling stops the next renewal; access continues until the end of the period you have already paid for.
Free trials. If a subscription includes a free trial, any unused portion of that trial period is forfeited when you purchase a subscription, where a trial is offered for that app.

Lifetime access (one-time purchase)

Some apps offer lifetime access as a one-time purchase, instead of or in addition to a subscription. The following applies where an app offers it:

One-time payment. Lifetime access is a single, non-recurring purchase. It does not auto-renew, and you will not be billed again for it.
What "lifetime" means. Lifetime access unlocks the designated paid features or content for as long as we continue to publish and support the App on the App Store. It refers to the lifetime of the App, not the lifetime of the purchaser, and does not oblige us to keep the App available indefinitely.
Restoring your purchase. Lifetime access is a non-consumable purchase, so you can restore it on your other eligible devices using "Restore Purchases" in the App, and it may be shared through Family Sharing where we enable it.

6. Refunds

Purchases and subscriptions are processed by Apple through the App Store, not directly by us. Requests for refunds are handled by Apple in accordance with Apple's policies. Because we do not process the payment, we are generally unable to issue refunds directly; please contact Apple Support for refund requests.

7. Intellectual property

The App, its design, and its content are owned by us or our licensors and are protected by copyright and other laws. Except for the licence granted in these Terms, no rights are transferred to you.

8. Maintenance, support and warranty

We — not Apple — are solely responsible for providing any maintenance and support for the App, to the extent such support is required by applicable law or offered by us. Apple has no obligation to furnish any maintenance or support for the App.

To the maximum extent permitted by applicable law, and subject to your mandatory statutory rights as a consumer, we are responsible for any product warranties, whether express or implied, that are not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price of the App to you (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App. Any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are our responsibility, not Apple's.

9. Product and intellectual-property claims

We, not Apple, are responsible for addressing any claims relating to the App or your use of it, including, but not limited to: product liability claims; any claim that the App fails to conform to any applicable legal or regulatory requirement; claims arising under consumer protection, privacy, or similar legislation; and claims that the App infringes a third party's intellectual property rights. In the event of any such intellectual-property claim, we — not Apple — are solely responsible for the investigation, defence, settlement, and discharge of the claim.

10. Apple as a third-party beneficiary

You acknowledge that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

11. Legal compliance

You represent and warrant that you are not located in a country subject to a relevant government embargo, or that has been designated as a "terrorist supporting" country, and that you are not listed on any relevant government list of prohibited or restricted parties.

12. Disclaimer

Except as required by mandatory law and subject to your statutory consumer rights, the App is provided "as is" and "as available" without warranties of any kind. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

13. Limitation of liability

Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including for death or personal injury caused by negligence, for fraud, or for any liability that cannot be excluded under mandatory law (including the German Product Liability Act). Subject to that, and to the extent permitted by law, we are not liable for indirect or consequential losses arising out of your use of, or inability to use, the App.

14. Changes to the App and these Terms

We may update the App and these Terms from time to time, for example to reflect new features or changes in the law. The version published on this page applies to your use of the App. Continued use of the App after an update means you accept the revised Terms.

15. Governing law

These Terms are governed by the laws of the Federal Republic of Germany, without prejudice to any mandatory consumer-protection provisions of the country in which you have your habitual residence.
