Terms of App Usage

1. Who we are

These terms govern your use of the German Vocabulary app ("the app"). By downloading or using the app you agree to them. Apple's standard Licensed Application End User License Agreement also applies; where these terms are stricter, these terms apply between you and us.
2. What the app is
The app is a German vocabulary learning tool: flashcards, spaced-repetition reviews, targeted drills, word search with audio and pictures, progress insights, and the optional Learn with friends feature. It is a learning aid — we do not promise any particular learning outcome, exam result or level of fluency.
3. Free tier and full access
- The app is free to start. The free tier includes a limited allowance (for example a daily word-search allowance) enforced per device.
- Full access is available as a purchase through Apple's App Store. Payment, receipts and refunds are handled entirely by Apple under Apple's terms; we never see your payment details.
- Unlock codes we hand out personally can be redeemed in the app. Codes are non-transferable, may not be resold or published, and can be deactivated if abused.
- Statutory rights, including any withdrawal rights under EU consumer law exercised through Apple, remain unaffected.
4. Your content
Words, example sentences and edits you create stay yours. If you enable "share my new words", you grant us a simple, non-exclusive, royalty-free right to review, edit and include the submitted words in the app's vocabulary so other learners can benefit; your name is not attached. Don't submit content that infringes third-party rights or is unlawful.
5. Fair use and the leaderboard
- Use the app only through the official, unmodified copy from the App Store; don't reverse-engineer, probe or overload our servers, or circumvent free-tier limits or device-authenticity checks.
- If you join the optional Learn with friends feature: choose a nickname that isn't offensive, impersonating or otherwise abusive. Don't cheat, manipulate scores, or harass other participants. We may hide or reset manipulated figures and may suspend or delete leaderboard profiles that break these rules.
- Leaving the leaderboard or deleting its profile never affects your learning data.
6. Our content
The vocabulary database, example sentences, audio recordings, pictures, app design and software are protected by copyright and other rights. You get a personal, non-transferable, non-exclusive licence to use them within the app for your own learning. Extracting, scraping or republishing the content is not permitted.
7. Availability and changes
Content downloads, search, leaderboard and other online features depend on our servers and third-party services (Apple, Cloudflare). We aim for high availability but do not guarantee uninterrupted service. We may develop, change or discontinue individual features; where a change materially reduces paid functionality, we will say so in the app. Core learning works offline once content is downloaded.
8. Liability
We are liable without limitation for intent and gross negligence, and for injury to life, body or health. For simple negligence we are liable only for breach of essential contractual duties (duties whose fulfilment makes proper performance possible at all and on which you may regularly rely), limited to the foreseeable damage typical for this kind of contract. Liability under the German Product Liability Act remains unaffected. Back up your device — the app syncs learning data through your own iCloud, which we cannot access or restore for you.
9. Termination
You can stop using the app at any time by deleting it. We may terminate or restrict use of the online features for serious or repeated breach of these terms; your statutory rights and any rights through Apple regarding purchases remain unaffected.
10. Changes to these terms
We may update these terms when the app gains or changes features. The effective date above changes with each update, and material changes are announced in the app. Continued use after a change constitutes acceptance; if you do not agree, stop using the app.
11. Governing law
German law applies, excluding its conflict-of-law rules. If you are a consumer, the mandatory consumer-protection rules of your country of residence remain unaffected. The European Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr; we are neither willing nor obliged to participate in dispute-resolution proceedings before a consumer arbitration board.
